Please read the terms and conditions (“Terms and Conditions”) set out below carefully before registering with us to become a Member or ordering any Goods from us. When you apply to become a Member or order any Goods from us you agree to be bound by these Terms and Conditions. The contract for membership of the Studio or the purchase of any Goods is between you and Bikram Yoga Nairobi

  1. DEFINITIONS

     

“Agreement” is a reference to these Terms and Conditions, the Privacy Policy, the Studio Etiquette, any application form and payment instructions provided to you;

“Goods” is a reference to any goods which we may offer for sale from our Website or in the studio from time to time;

“Member(s)” is a reference to any person who has registered and made payments with us to use the Studio and to become a member;

“Privacy Policy” means the policy displayed on our Website or physically in our studio premises which details how we collect and store your personal data;

“Studio” is a reference to the facility where we provide Bikram Yoga classes;

“Studio Etiquette” means the rules of the Studio applicable to all members which are displayed on the Website and in the Studio;

“you”, “your” and “yours” are references to you the person accessing this Website, applying for membership and/or ordering any Goods from the Website and in the Studio;

“BYN”, “we”, “us” and “our” are references to Bikram Yoga Nairobi; and

“Website” is a reference to our Website www.bikramyoganairobi.com

2. MEMBERSHIP AT BYN 

2.1. We offer a range of different membership packages to suit our Members. Details of the current membership packages available are published on our Website and displayed at our Studio.

2.2. Once you have selected a membership package you will need to register with us to become a Member by making the appropriate payment prescribed for each class of membership. For those applicants under  the age of 18 years, you must be accompanied by a parent or guardian when attending the Studio. All Members, including temporary Members, are required to complete an application form requiring you to provide contact and medical details.

2.3. By registering with us you agree to be bound by these Terms and Conditions,  the Privacy Policy and  the Studio Etiquette protocols.

2.4. Whenever you submit your application form or visit the Studio, you warrant and represent to us that you have no medical conditions known to you that would prevent you from engaging in any and all forms of exercise including, but not limited to, yoga-related exercises in a heated room. If in doubt at any time, it is your sole responsibility to consult a medical practitioner and cease attending classes until you are satisfied that you are in good health and can perform the exercises safely.

2.5. Please ensure that you familiarise yourself with any restrictions that may apply to your membership package. Introductory offers are subject to restrictions which are displayed on our Website. Certain packages may be designated as “Off Peak” or “Peak” packages which will entitle you to attend yoga classes at certain times and subject to package rules. Full details are displayed on the Website along with a current timetable of classes. If you have purchased an “Off Peak” membership package you will not be able to apply that package to attend classes in designated “Peak” periods.

2.6. Some membership packages are provided in the form of Class Cards (or Count-Series memberships) which entitle the holder of the card to attend a specified number of classes over a set period. Extensions to the Class Cards may be purchased at the prices and subject to the terms stated on the Website and at the Studio. Other membership packages are designated as Time-Series memberships which entitle the holder, subject to the specific package rules, to attend one or more classes per day over a limited period of time.

3. HEALTH AND SAFETY

 

3.1. It is your responsibility to monitor your own physical condition throughout any exercise programme. In the event of any unusual symptoms occurring, you should cease practising and inform a member of staff immediately and also in writing to info@bikramyoganairobi.com as soon as it is conveniently possible to do so. You should not attend class until you are satisfied that you are in good health and can perform the exercises safely.

3.1 Illness: You do hereby expressly forever release and discharge BYN and its employees, directors and contractors from any claims related to the contraction of any illness within the premises of BYN, its building or surrounding area. Should you contract any transmissible illness, you will inform BYN in writing as soon as possible and will not return to BYN until you are confirmed as clear of the illness and will isolate as per government guidelines. If you have symptoms of any transmissible illness you will not return until you have been cleared by your physician to do so. In such circumstances, you will not be due any refund for any unused portion of your membership.

3.2. Prior to commencing the yoga classes, you should satisfy yourself that this is the appropriate exercise programme for you. We cannot take any responsibility for any injury that you may sustain as a result of participating in a class at the Studio 

3.3. Yoga classes may be offered to children from time to time from the Studio. Anyone under the age of 18 years must be accompanied by a parent or guardian when attending the Studio and using the changing facilities. Children attending children’s yoga classes must be brought to and collected from the class by a parent or guardian. No child over the age of 7 may use a changing room reserved for the opposite gender whether or not the child is accompanied by an adult.

3.4. CCTV: Our studio locations may have CCTV installed in order to help protect the property and safety of visitors and staff. Any images and footage are treated as private information, with confidentiality and care.

3.5 There may be instances in which the teacher is unable to attend a class to teach. We will seek to find a replacement (cover) teacher for such classes where feasible. In some instances, we may be unable to find a cover at short notice.  If you arrive at the studio for a class in which the teacher is absent and decide that you would prefer not to attend, your class will not be charged and you can retain that class credit for future use. Should you prefer to stay and engage in self-practice, either by following taped instructions or by following your own regime or that of another student, you understand and accept that you do so at your own risk.

3.6 LIVE STREAMED CLASSES: During the Covid-19 closures, BYN May offer classes streamed live over the internet.  Your wellbeing is very important to us, and when participating in any of our live streamed classes, you understand that you will be performing exercises without the physical presence of a teacher in the room to fully observe you. In addition to following and accepting guidelines for in-studio classes, you accordingly agree to observe the following:

  • To avoid pushing beyond your existing limits. When you’re practicing yoga or any other exercises outside the hot room, you may find that it takes longer to warm up and that you could be more prone to injury if you attempt to push too hard.

  • To ensure you have a completely cleared, safe space to practice around you that has no trip hazards or items of furniture. 

  • To remove all jewellery when exercising. 

  • To avoid practicing if you’re unwell, or pregnant either now or within the past 6 months. 

  • To ensure you have booked into our classes through the schedule page on this website. 

  • To have a capable person present in your premises to assist you in case of an adverse event/injury.  

  • To avoid attending online sessions if you’re in any way unsure as to your ability to practice safely.

3.7 You understand that BYN may, from time to time, record and stream live through transmittable media the classes which you attend for the purposes of making such classes available to viewers online. You acknowledge that where reasonably possible BYN will use reasonable efforts to ensure that your image is not identifiable on such media, however, to the extent that your image is identifiable to viewers of this media, you hereby give your consent to the use of your image for the purposes of making the classes available to online viewers.

4. PURCHASING ONLINE

 

4.1. You agree to take particular care when providing us with your details and warrant that these details are accurate and complete at the time of ordering. You also warrant that the credit or debit card details that you provide are of your own credit or debit card and that you have sufficient funds to make the payment. `

4.2. Please note that some of our Goods may be suitable for certain age ranges only. You should check that the product you are ordering is suitable for the intended recipient.

4.3. When purchasing from this Website you may be required to provide a username and password. You must ensure that you keep these details secure and do not provide this information to a third party.

4.4. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your purchase and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or purchasing from the Website.

4.5. Any purchase that you place with us is subject to product or service availability and acceptance by us. When you place your order online, we may send you an email to confirm that we have received it. This email confirmation will be produced automatically so that you have confirmation of your order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your order. If the Goods are unavailable or the details of the order are incorrect, we will inform you as soon as practicable.

4.6. All prices and terms listed on the Website are to the best of our knowledge correct at the time of publication; however, we reserve the right to alter these in the future and in the event of an error in the published price or terms will not be held liable and may alter them without notice. We also reserve the right to alter the membership packages or Goods available for sale on the Website or through the Studio and to discontinue any product line or service.

4.7. The contract for the Goods or membership will be accepted at the time of despatch of your order or confirmation by us that your application for membership has been accepted. We may confirm this to you in writing. You must inform us immediately if any details are incorrect. If your order has not been accepted you will be notified of this together with the reasons.

4.8. In the event that you have purchased a membership package for which you are not eligible, we reserve the right to invalidate the package and charge you for the portion used. The amount of the charge for your partial use of the package shall be based on the cheapest package we can make available to you.

5. ONLINE BOOKINGS

 

BYN is pleased to offer all of our members the ability to book classes online. We operate this programme under the policy stated here below:

5.1. Booking Windows: Class spots can be reserved online by any member who has an active, valid package covering the period for the classes they wish to reserve. You may book your class starting 14 days ahead and up to 30 minutes prior to the start of a class (“booking window”).

5.1.1. All bookings must be made by the client using the BYN online reservation system. We do not take bookings by email or phone.

5.2. Waitlists: For classes that are fully booked up, you can place yourself on our online ‘waitlist’ beginning 14 days before the class. Once you are on the ‘waitlist’, as available spots come up in the class, then subject to subclause 5.2.1, you will be moved from the ‘waitlist’ to a confirmed spot in class and will automatically be emailed notification of this.

5.2.1. If space becomes available more than 8 hours prior to the class start time, then ‘waitlist’ places are automatically moved into class. If space becomes available less than 8 hours before the class start time, you may be able to book online without adding yourself to the ‘waitlist’.

5.3. Cancelling a Booking: If you wish to cancel an online booking, you must do so yourself via the online booking system at least 3 hours before the start of a class (the “cancellation deadline”) or your booking will be treated as either a ‘Late Cancellation’ or a ‘No Show’. Note seminars, workshops and other special events requiring a separate event fee cannot be cancelled online or refunded.

5.3.1. We do not accept phone or email cancellations. You must cancel the booking by accessing the BYN website with your login.

5.4. Late Cancellations and No-Shows: If you have booked online you must scan your BYN keytag in at reception at least 15 minutes before the class start time, and you must attend the class you have booked. Failure to do so will be treated as a ‘Late Cancellation’ or a ‘No Show’, in which case your space may be allocated to another person and you will incur a ‘Late Cancellation Fee’ or a ‘No Show Fee’.

5.4.1. Late Cancellation Fee / No Show Fee: This booking policy has been created for all members of the studio to enjoy and utilize, therefore it is important that everyone follows the rules to ensure the system works smoothly and for the benefit of everyone. The ‘late cancellation’ and ‘no show fees’ are non-negotiable and non-refundable and will be automatically charged to the payment card associated with your account or at the studio at your next visit. Until the time the fee has been paid, we reserve the right to suspend your booking and/or class attendance privileges.

(a) Your booking will incur a KSH 300 ‘Late Cancellation Fee’ if you cancel your booking “late”, that is, you cancel your booking, but only after the ‘cancellation deadline’ and before the class start time;

(b) Your booking will incur a ‘No Show Fee’ if you do not cancel your booking and do not scan into and attend the class that you have booked. If you have a Class Card the “No Show Fee’ will be affected by us subtracting one class from your membership package. If you have a Time Series package, such as an annual or monthly unlimited membership, you will be charged KSH 1000.

(c) If you book a class on a new Time Series package, such as a 1-Month Unlimited or the Introductory Offer, and fail to cancel online at least 3 hours prior to that class if you can’t attend, your package officially activates and time starts elapsing.

5.5. Attending without Booking: Except during times when social distancing measures are in effect, you are welcome to come to class without a reservation if a spot is available. All BYN members who have been provided a BYN keytag must scan in with it.

6. PRICES AND PAYMENT

 

6.1. All prices and terms listed on the Website and in the Studio are correct at the time of publication; however, we reserve the right to alter these in the future without notice. Prices are inclusive of value added tax but exclusive of delivery charges, which will be added to your purchase where applicable.

6.2. The total price for Goods or membership ordered, including delivery charges, will be displayed on the Website when you place your order. If purchasing Goods full payment must be made before Goods are despatched.

6.3. You must pay for your Goods order before it is delivered and you can do so by debit or credit card. To ensure that shopping online is secure, your debit/credit card details will be encrypted to prevent the possibility of someone being able to read them as they are sent over the Internet. Your credit card company may also do security checks to confirm it is you making the purchase.

6.4. Time Series memberships and Class Cards must be paid for in advance at the time of membership application. Payment for all online purchases may be made by credit or debit card. Payment may also be made by cash, cheque or Mpesa.

6.5. Memberships may be paid for on a monthly subscription basis via Debit or Credit card. There is a minimum 12-month contract or month to month subscription (for early termination please see section 7). Your Card will be charged at the beginning of every month for your subscription amount.  If your card declines for insufficient funds you be charged KSH 1000 decline fee. Should your card not go through for any reason you will be obliged to clear any outstanding balance before being allowed to practice.

6.6. We will notify you of any increase in your membership rates when such increase becomes applicable, which is typically at the end of each 12-month anniversary of your membership. You will usually be given 30 days’ notice of any increase and the increased amount will be payable in the following month.

7. MEMBERSHIP CANCELLATION OR TERMINATION AND HOLDS

 

7.1. you may cancel your membership package by notifying us in writing within 7calendar days of confirmation of your order provided that you have not used any part of your membership. A full refund will be made within 30 days of receipt of notification.

7.2. If you are on a Month to Month Auto renew membership and wish to cancel you may do so with 14 days written notice to info@bikramyoganairobi.com Failure to provide written notice within this period will constitute your acceptance to remain in the program and you will be charged at the beginning of the month as part of our ongoing monthly commitment.

7.3.Termination of the contract under exceptional circumstances: – Both Parties can terminate the Auto-Renew membership at any time if there is a breach by any party  of any of these terms and conditions and  which breach persists and remains unresolved for a Period of 30 days upon its occurrence, Provided that a notice of 14 days from the occurrence of the breach is served upon the defaulting Party by the innocent party , with a request that the breach be made good or rectified by the defaulting Party. 

You may request a termination within 30 days notice period following the end of the current month of your Auto renew membership if you feel that your circumstances have changed to such an extent that it is not possible for you to continue to participate in yoga classes (for example, you acquire a critical long-term injury or illness that prevents you from exercising, move to a different workplace and/or house resulting in both your workplace and house being outside a 15-mile radius from our location, become pregnant, or are made redundant). You should however note that, even when any of these conditions affect you, the contract cannot be terminated prior to the lapse of the first 6 months of your membership (‘which is the absolute minimum term’). We will need to see medical or other documents to ascertain the change in your circumstances. Please contact us whenever any such condition occurs to you to enable us find the most appropriate membership option for you .In any such an occurrence, It will be at the discretion of the studio to either  grant a termination of the membership or at our sole discretion choose to freeze the membership or provide any other suitable membership option to suit the  prevailing circumstances of the affected member.

Where we agree to early termination of your Auto-Renew membership we shall be entitled to withhold the deposit paid by a member at the time of making application for this membership option, or in the case of an upfront payment, we may at our sole discretion give a pro rata account credit (not a cash refund) of the amount paid adjusted for usage and termination notice, less an amount equal to one month’s unlimited membership. Should such ‘early termination’ of your Auto renew membership be accepted by us, the termination shall be deemed effective as of a 30 day notice period following the end of your current month of membership (taking into account the absolute minimum term); and, in case of payment upfront, a pro-rata credit, if any, shall be calculated on that basis. Barring the fulfillment of the absolute minimum term, the amount withheld shall be capped at two months’ worth of your membership, including forfeiting your initial deposit. 

7.4. Membership Transfers: – Your membership is not transferable to anyone else. Allowing anyone else to use your card or membership number represents a serious breach of these Terms & Conditions. Cards or packages being used by any other person other than the authorised member will result in that membership being cancelled and no refund of the membership or current class package fee will be paid. In some exceptional cases, we may consider membership transfer. Any request for membership transfer should be notified to us in writing and any decision will be made by us at our sole discretion.

7.5. Money on Account after Termination: – We allow customers to put cash balances as credit on their accounts to purchase goods or services at the studio at a later point in time, commonly called “money on account.” These funds are generally only refundable within 7 days of crediting the client account and are not refundable after this period has passed. 

7.6. Only certain membership types can be put on hold or “frozen”.  These include our 6-month unlimited membership, our 1-year unlimited membership and our 12-month Auto-renew contract. All hold requests must be received in writing to info@bikramyoganairobi.com within a minimum of 14 days’ notice.

7.6.a 6-month Unlimited memberships can be put on hold for a maximum of One (1) time only and for a minimum of 3 weeks and a maximum duration of 3 months. 6-month unlimited membership will be extended by the period they were held.

 

7.6.b 1-year unlimited memberships can be put on hold for a maximum of two (2) times only and for a maximum duration of 3 months . Annual unlimited membership packages will be extended by the period that they were held.

 

7.6.c. You may request a Suspension of your annual or auto-renewing membership, up to two times, for a minimum of one calendar month and up to a maximum of three consecutive months, in one-month increments, within any and each 12-month period, by providing us with a written request at least 14 calendar days prior to the calendar month you want the suspension to be effective. You will be required to pay an administrative fee of ksh 3000 per month for the calendar month(s) during which your annual membership is suspended which will be charged automatically to your card and the ksh 1000  fee shall apply incase the payment is declined due to insufficient funds in your Card.  Bikram Yoga Kenya Ltd. is not obligated to refund any membership fees where the Member has not provided the appropriate notice as set out in these Terms and Conditions

 

7.7. Under exceptional circumstances the studio may at its sole discretion find a solution for a member who is not able to practice due to some medical or unexpected personal circumstance. In this case the member may be required to provide proof or documentation to support claims of injury or exceptional circumstances.  In such cases the member will inform the studio in writing and any remedy offered by the studio will be on a go forward basis from the date the studio is notified of the issue.

7.8. Termination by us: – We reserve the right to terminate your membership at any time if we have reasonable grounds to believe that any of the following situations have occurred:

7.8.1. you have acted in breach of these Terms and Conditions (which shall include non-payment of membership fees) and/or the Studio Etiquette;

7.8.2. your behaviour within the Studio is unreasonable, abusive or offensive to other members, staff and the Management;

7.8.3. your actions within the Studio put you, other members or staff, or any property at risk; or

7.8.4. we have a reason to believe that you have engaged in or are attempting to engage in any illegal activity within the studio.

7.9. In all cases of termination by us you will not be entitled to a refund of any membership you may have paid in advance and, in cases of 12-months Auto-renew, you will also be liable to pay the balance of any membership fees where termination takes place part way through the first 12 months of membership or any other agreed minimum period according to your membership agreement.

8. YOUR INFORMATION

 

8.1. Where we have requested information from you to provide Goods or services you agree to provide us with accurate and complete information.

8.2. You authorise us to use, store or otherwise process your personal information in order to provide the Goods or services to you and for marketing and credit control purposes (the “Purpose”). The Purpose may include the disclosure of your personal information to selected third parties from time to time, with your permission in cases where we believe that the services offered by such third parties may be of interest to you, or without further notification where this is required by law or in order to provide the Goods or service to you. Except as specifically otherwise indicated in our Privacy Policy, we will not pass on or sell your private information or contact details to any third parties for their marketing purposes. More information can be found in our Privacy Policy.

8.3. You are entitled to request a copy of the personal information we hold on you. Please contact us if you wish to request this information.

9. LINKED SITES

 

There may be a number of links on our Website to third party Websites which we believe may be of interest to you. We do not represent the quality of the goods or services provided by such third parties nor do we have any control over the content or availability of such sites. We cannot accept any responsibility for the content of third-party Websites or the services or goods that they may provide to you.

10. COMPLAINTS

 

We take complaints very seriously and aim to respond to your complaints within 5 business days. All complaints should be addressed to info@bikramyoganairobi.com.

11. LIMITATION OF LIABILITY

 

11.1. Great care has been taken to ensure that the information available on this Website is correct and error free. We apologise for any errors or omissions that may have occurred. We cannot warrant that use of the Website will be error free, fit for purpose, timely, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the Website; and we do not make any warranty whatsoever, whether expressed or implied, relating to fitness for purpose or accuracy.

11.2. We disclaim any and all liability to you for the supply of our yoga services and any Goods purchased from us (whether via this Website, at the Studios, or through our streamed classes) to the fullest extent permissible under applicable law. This does not affect your statutory rights as a consumer. If we are found liable for any loss or damage to you such liability is limited to the amount you have paid for membership or the relevant Goods, taking into account any usage of your membership or Goods. We cannot accept any liability for any loss, damage or expense, including any direct or indirect loss such as loss of profits, to you howsoever arising. 

11.3. We do not accept any liability for any delays, failures, errors, omissions or loss of transmitted information, viruses or other contamination or destructive properties transmitted to you or your computer system via our Website.

11.4. We shall not be held liable for any failure or delay in performing our membership services or delivering Goods where such failure arises as a result of any act or omission which is outside our reasonable control such as an act of God or those of third parties.

11.5. The products sold by us are provided for private domestic and consumer use only. Accordingly, we do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the Website or for any products or services purchased from us.

11.6. We have taken all reasonable steps to prevent internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers or those of third parties.

11.7. We provide lockers free of charge and advise that you use them. We will not be liable to you for any loss, damage or theft of any property you bring onto our premises while it is not in a locked locker. For items that you can demonstrate have been removed from locked lockers or have been lost through any clear negligence on behalf of BYN, you will firstly need to file a police report indicating the loss, and secondly an insurance claim with your insurer, or in the case that you do not have such insurance make a written statement to us to that effect. Our liability in these instances, if any, to you will be limited to the lesser of the proven value of the item after adjusting for any usage and after any consideration you have received from your insurer.

11.8. Any bicycles, vehicles or their contents parked inside or outside any BYN premises are left entirely at their owners’ risk, and BYN will not accept any liability for loss, theft, or damage that may occur to them. 

12.GENERAL

 

12.1. We may subcontract any part or parts of the services or Goods that we provide to you from time to time and we may assign or novate any part or parts of our rights under these Terms and Conditions without your consent or any requirement to notify you. We may change the location of the Studio at any time and will provide you with as much notice as is practicable.

12.2. We may alter or vary the Terms and Conditions at any time and any revised terms will be displayed on our Website and you will be invited to accept the revised terms.

12.3. The Terms and Conditions together with the Privacy Policy, the Studio Etiquette, any application form and payment instructions constitute the entire agreement between you and us. No other terms whether expressed or implied shall form part of this Agreement. In the event of any conflict between these Terms and Conditions and any other term or provision on the Website, these Terms and Conditions shall prevail.

12.4. If any term or condition of our Agreement shall be deemed invalid, illegal or unenforceable, the parties hereby agree that such term or condition shall be deemed to be deleted and the remainder of the Agreement shall continue in force without such term or condition.

12.5. These Terms and Conditions and our Agreement shall be governed by and construed in accordance with the laws Kenya. The parties hereto submit to the exclusive jurisdiction of the courts of Kenya.

12.6. No delay or failure on our part to enforce our rights or remedies under the Agreement shall constitute a waiver on our part of such rights or remedies unless such waiver is confirmed in writing.

 

PRIVACY POLICY

 

We at BYN understand how much value you place on your privacy and we will always treat your private details with utmost of care. This policy explains how we, Bikram Yoga Nairobi use your personal information which you provide to us when using our website.

What information do we collect about you?

We collect personal information from you when you order goods or services from us, use our website, or use 3rd party websites linked to our website. We also collect information when you contact us by post, telephone or email, or complete any customer survey. Website usage information may also be collected using cookies.

Photographic information

We may, for the purposes of identification, keep on file an electronic photographic image of you. Furthermore, as stated in our general Terms & Conditions, photographs and/or video may be taken within our premises for journalistic features or to promote the studio and our services either directly or through our partners.

CCTV

Our studio locations may have CCTV installed in order to help protect the property and safety of visitors and staff. Any images and footage are treated as private information and will be treated with the same high standards of confidentiality and care with which we will treat your other private information.
